The BREEDER guarantees the above described dog to be healthy at the time of sale or your money back in exchange for the pup unless something else can be agreed upon. The breeder does not assume any liability for any injuries/illnesses made to or contracted by the puppy after delivery, due to the negligence or accidental misfortune of the buyer unfortunately. INITIAL_______ The BUYER agrees to have this puppy examined by a veterinarian within 5 business days of delivery to be able to take advantage of the health guarantees. (that time can be extended if needed) Breeder is to be contacted by the vet that will be providing a photocopy of the Health Certificate sent to the breeder if the puppy is found to be in poor health within the 5 day time frame, (or extended time that was agreed upon) then the buyer will have the option of choosing another puppy If granted, and the option will be presented to switch to the next litter ONLY, unless there's a written agreement stating otherwise between breeder and buyer. If that option is denied or can't happen for any reason, another middle ground will have to be agreed upon. INITIAL________ IF buyer proves to be a threat to pup AND/OR breeder, or breeder has good reason to believe pups will not be safe, correctly cared for, or at any time pup/pups are placed with someone who the breeder (Jessica Andree Pierre) has not agreed to, or at any point in time before AND/OR after puppy is paid for there's cause for concern for the well-being (dealing with physical or mental status of pup AND/OR breeder) at all in buyers care of the pup OR breeder as stated, Breeder can choose to deem the contract null and void AND/OR go to the FULL EXTENT OF THE LAW to take the puppy back due to neglect, abuse, and/or disregard for integrity or respect and/or defamation while dealing with such an important circumstance (A life/the pup or puppies) by THIS hobby breeder, Jessica Pierre only with proof of such instance of course.. Breeder (Jessica Andree Pierre) WILL HAVE TO prosecute to the FULL EXTENT OF THE LAW to keep every life that comes from breeders pups safe and in a place the breeder (Jessica Andree Pierre) has agreed to place them in. If any person at all rehomes a dog they got from me/the breeder without breeders consent, the buyer will owe a fine of $2,000 and the pup shall be returned to the breeder-Jessica Andree Pierre. Any disagreement about how the pup got in someone else's care is to be the sole responsibility of said pup/puppies initial buyer and the people whom the pup/pups were rehomed to. Breeder will take back the said pup and leave the consequence to be settled between the buyer and rehomed individual/individuals unfortunately. Like I have stated in my application if I'm asked about owner rehoming a pup/pups, I would be happy to accommodate that request as long as the new owners to be go through my same application process and sign my contract if approved, although no money will be owed to the breeder. INITIAL_______ The BREEDER provides a 25 month genetic hip guarantee under circumstances that don’t expose the dog to environmental causes. Should the puppy be diagnosed with hip dysplasia under those circumstances, the breeder will replace the puppy under the following conditions: The BUYER must provide a copy of documentation from the ORTHOPEDIC FOUNDATION FOR ANIMALS (OFFA) located in Columbia, Missouri, specifying that the puppy had hip dysplasia due to genetic fault. This is the only documentation that will be deemed acceptable by the BREEDER for the purpose of supplying a replacement puppy. The breeder will require a video of the conditions pups were kept by the owner. Once the breeder has received a copy of the documentation from the ORTHOPEDIC FOUNDATION FOR ANIMALS (OFFA) and found acceptable, the BUYER must return (at the BUYER’S expense), the puppy and its’ documents to the breeder-(Jessica Andree Pierre) The BUYER agrees that all vet costs for x-rays, etc., and costs involving submission of the hip x-rays to (OFFA) for evaluation, and all other vet costs while the puppy is not in the care of the breeder shall be the sole responsibility of the buyer unless otherwise stated by breeder. INITIAL_______ The BREEDER provides a one year genetic health guarantee. Should the puppy expire prior to its’ first birthday DUE TO A GENETIC DEFECT, the breeder will replace the puppy under the following conditions: If the BUYER agrees that the puppy expired for unknown reasons and the buyer requests another puppy, then a necropsy should be performed on the puppy and a written statement from the professional who preformed the necropsy is to be provided to the breeder-Jessica Andree Pierre as to the exact cause of death. If the puppy expired due to a GENETIC DEFECT, a replacement will be provided as soon as possible ONLY AFTER the written statement from vet and Myself (the breeder) speaking to the vet/medical pathologist that wrote the statement. NO REFUNDS will be made after 72 hours of ownership unless discussed and agreed upon and will not include the holding fee. (Because I care and want everyone to have a pleasant experience dealing with me and my puppies and no one should have to go through anything like that if by rare chance it were to happen, I obviously do provide other options to help guide everything in a helpful manner) INITIAL_______ If the puppy is found to have a genetic defect during its’ first year of life, a replacement puppy will be provided upon receipt of a written statement from a veterinarian (And contact by phone or in person from the same veterinarian) as to the exact type of genetic defect, and with proof of passed puppy and return of its’ documents. The BUYER agrees that all vet costs incurred on said puppy are the sole responsibility of the buyer unless agreed otherwise. The BUYER agrees that all traveling costs to return a defective puppy and to acquirer a replacement puppy, will be the sole responsibility of the buyer after leaving breeders care for all reasons unless agreed otherwise under special circumstance. INITIAL_______ The BUYER agrees to maintain the puppy’s health in good condition and provide yearly examinations, vaccinations (if your preference is for vaccinations and not against it. If against vaccinations, replacement safety precautions should take place with caution and experience or credible researched information and homeopathic remedies should take place in addition to a well balanced nutrition like what I provide them before they leave my care and included in the care package sent home with each pup or any other similar nutritional diet plan of your choice) and any other customary procedures necessary to good health. INITIAL_______ The BREEDER has done everything possible to produce healthy, sound puppies and by raising the puppies in the best way possible in regards to diet, exercise, socialization, conditioning and care. A record of worming history is supplied to the buyer at the time of sale. (Vaccination decisions will be left up to the buyer for personal preference and comfort unless agreed otherwise by choice of the buyer with informed consent after 12 weeks of age.) If any pup passes away from a reaction of any kind or anything related to or suspected to be related to vaccinations unfortunately the breeder shall take no action to help in any way financially but will be on call for emotional support and guidance to help sort everything out. Reason being for that circumstance is I do not agree with any pup being vaccinated under 12 weeks of age, in a case where someone wants to vaccinate or have their puppy vaccinated sooner than 12 weeks of age, my health guarantees and option to pick a different puppy will be NULL AND VOID. I have done a lot of research and I'm updated on statistics proving that is in the best interest of all puppies by very credible sources. I MUST put the best interest of my dogs first and the happiness, and satisfaction of all my husky families/buyers second in order to be an ethical, reputable sustainable breeder. I understand not everyone cares to do things this way but I will. INITIAL_______ The BREEDER can offer no other guarantees once the care of the puppy is no longer under their supervision. The BUYER hereby AGREES that if at anytime, the buyer cannot take proper care of the puppy, Or for any reason at all the puppy will have to leave the care of the buyer, the buyer WILL CONTACT THE BREEDER NO MATTER THE CIRCUMSTANCE and the breeder will have first choice to either: 1) Take the puppy back 2) Assist the buyer in finding a suitable home for the puppy. INITIAL_______ If the seller AND breeder agrees on the buyer rehoming, the new owner would have to speak with the breeder as above mentioned to also read and sign this exact contract and go through the same application screening process of any other buyer that has gotten a puppy regardless of and exchange or lack of exchange of money to the breeder. INITIAL_____ (I, Jessica Andree Pierre at Blue Moon Husky Haven would be happy to work with anyone and allow a friend or family member to take over primary care if requested. In order for that to be made possible responsibly on my part they would also have to sign these documents and agree to these terms even though they aren’t paying anything to the breeder. To me this is one of the most important parts of this contract so that I can rest assured that no life I bring into this world will have to end up in a shelter, mistreated, or left behind.) For those reasons updates will be kindly required at least every 6-8 months in the first two years of the puppies life with vet records then every year after that so that I can make sure my pups are all doing well and are safe and still placed where they should be. Also for that reason there has to be a $2,000 FINE as mentioned above for the return to breeder clause to hold up in court as a safety net for all my babies, and a $8,000 for anyone who breaches ANY PART of this contract involving breeding without breeding rights AGREED UPON AND PAID FOR IN FULL whether intentional or not intentional. If you have agreed to limited rights, expressed that you will not be breeding and/or not been approved for or paid for breeding rights, you will have to have any said pup/pups spayed/neutered by the age of 12 months old or whatever age your vet recommends you have it done. It is your responsibility to make sure your new pups do not accidentally reproduce. Not notifying me if your not able to care for the pup any longer so that we may work something out, or that any pup from me is no longer living or missing is a breach of contract that you are acknowledging by signing this contract will be a separate $500 fee plus all court costs involved for all parties. Which means blocking me while still having my lines in your care would also be a breach in contract and would also involve an additional $500 fine IF I'm not able to get in touch with you in any other way. Another few good reasons to provide your breeder with any and all feedback, especially vet feedback is so that you can feel confident that you have an ethical, experienced pup manager, trainer and homeopathic healer on speed dial FREE at any time you may have any questions or concerns alongside your vet of course!! 🙂 (I may be able to help with advice, tips, and suggestions on what to do or what not no do so that I can correct anything that may not work for everyone, continue what does, and always improve my past, present, and future pups temperament and health. So these pups future will always look bright and you will always know that I care greatly about each and every one of my Husky babies and each and every husky family I have the pleasure of meeting and working with! The ONLY reason I have fines in my contract like most other ethical breeders is so that I can rest assured that if in any rare event anything goes wrong, my contract will hold up in court. INITIAL_______ The BREEDER neither makes nor implies any warranties or guarantees, express or implied, other than those written in this agreement. This document constitutes the entire agreement between BREEDER and BUYER with respect to this sale. The breeders and buyer’s signature below indicates that he/she/ has read, understands, and agrees to all the conditions of the SALES AGREEMENT, and that this contract is under the jurisdiction of the State of Alabama, in the County of Mobile. It is agreed the place of venue shall be Mobile County, Alabama.
